A court official confirmed Wendler did not appear at a scheduled court hearing Tuesday at the district court in Dinslaken, Germany — Wendler's home town — for a case involving him and rights to music as well as a foreclosure issue.

Singer stews: Michael Wendler, German pop star living in Cape Coral, in hot water over comments on COVID-19 rules

A former friend and business associate of Wendler, Timo Berger of Germany, attended the hearing, and said the court listed a possible fine and punishment for Wendler if he continues to avoid making an appearance.

"If he is (found) guilty he will get 100,000 Euro fine," Berger, one of five observers allowed in the court, said, which is the equivalent of $120,000. Berger added that Wendler could also get six months of probation.

"The judge wants him in jail until the next hearing," Berger said. "His lawyer told the judge that (Wendler) preferred to stay in Cape Coral. The judge made the decision that this hearing can not happen without Wendler to be here in person."

Wendler has challenged claims in the suit.

Henning Bierhaus, regional court judge and press officer from the Duisburg Regional Court, which oversees the Dinslaken district court, confirmed the hearing in a statement to The News-Press on Wednesday.

"The background to the appointment is a criminal warrant procedure on the allegation of aiding and abetting to thwart the foreclosure in unity of offense with bankruptcy in two cases," the judge said. "The court summoned the defendant (Tuesday),  as is customary in such cases, and ordered him to appear in person. Since the defendant did not appear at the appointment, the Duisburg public prosecutor filed an application for an arrest warrant to be issued. During the hearing, the court found that the accused had been properly summoned to the appointment and did not appear without excuse. For this reason, it issued an arrest warrant against the accused under Section 230 of the Code of Criminal Procedure."

One publication, the Kurier newspaper in Vienna, Austria, reported Tuesday that it was not clear whether an arrest warrant from Germany could be carried out in the U.S.

The major German newspaper Bild reported that Bierhaus confirmed that diplomatic channels have been used with the U.S. to try to get to Wendler. 

"In the event of his non-appearance, the penalty order challenged by him could become final. Then he would have a criminal record,“ the Bild story quoted the judge saying.

Bierhaus, asked if he knew if any U.S. effort would be made in this specific instance, responded via email Wednesday: "In the Federal Republic of Germany ... the enforcement of an arrest warrant is the responsibility of the so-called enforcement authorities and not the court. The court issues the arrest warrant, it is not carried out from here. Unfortunately, I do not know whether the German enforcement authorities intend to contact the US authorities on this matter."

The U.S. Department of Justice did not respond to an inquiry by The News-Press about its involvement in the case.

Wendler did not answer the door for a reporter who went to his Cape Coral home and did not answer News-Press queries made via social media.

Berger came to Cape Coral in January in an effort to reach Wendler. He stopped at Wendler's Cape Coral home with a German television crew. They were not successful.

Beger's first visit in December also ended with no contact with Wendler.

Wendler, 49, who crooned his way into the hearts of fans across Germany, Austria and Switzerland for years, and was a panelist on the German equivalent of American Idol, has been in hot water in the past year. 

In December, he commented on new German COVID-19 rules and compared the protective measures with Nazi concentration camps.

German media later reported that Wendler's concentration camp comparison prompted a German radio boycott of his music and an outcry from German fans and others on many of the country's media websites.
